LICENSING DECISION APPEAL PROCESS
If you have applied to the Cosmetology Association of Nova Scotia for licensure and your application (request) has been denied, you have the right to appeal the decision of the Executive Director.
An appeal request can be made via email, fax, or regular mail. There is no cost associated with an appeal.
Please Note: No person who was involved in an original credential review assessment and decision may partake in an appeal process or hearing related to that credential review decision.
Step 1
The Cosmetology Association must receive an appeal request with additional (new) supporting documentation from the credential review applicant within thirty (30) days of the original decision being rendered. Cosmetology Act, 2012, c. 39, s. 52(3) and By-Law 10.1
The Executive Director will review the appeal request and advise the Review Committee of the Appellant’s intention to appeal the original credential review decision within ten (10) days of receipt of appeal notice, with a copy of same being forwarded to Appellant.
Step 2
At least thirty (30) days prior to a hearing, the Review Committee shall notify the Appellant of:
The Review Committee may conduct a review by holding an oral hearing or considering written submissions only. Cosmetology Act, 2012, c. 39, s. 52 (5) and By-Law 10.1
A Review Hearing will be scheduled within 90 days of receipt of Appeal Notice.
Step 3
The Review Committee shall render its decision with reasons as to decision within twenty (20) days of the scheduled hearing date and provide a copy of the decision with reasons as to decision by electronic mail and regular mail to the Appellant and, if the Appellant’s appeal is denied, provide notice to the Appellant that the Appellant may appeal the Review Committee’s decision (on a matter of error in law only) to the Nova Scotia Court of Appeal within (10) days of the decision being rendered.
